Has your small business been negatively impacted by the COVID-19 pandemic crisis? Have you filed a claim toward your business interruption policy only to be denied by your insurance company? Are you frustrated at the amount of money you have spent on such a policy only to be denied when the coronavirus pandemic caused a real problem for your business?
We may be able to help.
At Dreesen Law Firm, we are seeing a trend across the country of business interruption claims being denied by insurance companies. The insurance companies claim that the cause of injury and interruption to the business does not qualify for coverage because of reasons like the crisis is unprecedented, pandemics are uninsurable, that COVID-19 is not specifically stated in the policy, that physical damage to the property cannot be proven, etc.
Matt Dreesen, at Dreesen Law Firm, stated that, “Small local businesses who are perceived as unable or unwilling to defend themselves will likely see an unprecedent amount of pushback from the big insurance companies due to the scope of this pandemic.” He went on to say, “ I feel that strategic legal defense and advocacy are going to be needed in order to be certain that claims on business interruption policies are honored properly.”
According to an article The National Law Review, “Many have already sued their carriers for declarations of coverage and improper refusal to honor their insurance contracts. “Claims [against insurance companies] include bad faith, failure to investigate, failure to promptly pay claims, unfair settlement practices, breach of contract, and violations of various state insurance codes.” Dreesen commented on this by saying that “our local small businesses in the Chesterfield, MO area are going to need legal guidance and the muscle of the courts on their side in this battle. They shouldn’t give up if denied and they shouldn’t fight alone.”
Here are just a few samples of cases already being filed across the country in behalf of small local businesses:
